What are the three elements of gambling?
Short answer: Consideration, chance, and prize. If all three are present, an activity is generally gambling under state law. Remove any one element — most commonly consideration or chance — and the activity usually falls outside gambling regulation.
Consideration means the player gives something of value to participate. Chance means the outcome is determined predominantly, or in some states materially, by randomness. Prize means the player can win something of value.
Most lawful game designs work by deliberately removing one element. Sweepstakes remove consideration through a free alternative method of entry. Skill contests remove or subordinate chance. Free-to-play social casino products remove the prize by making winnings non-redeemable.
The design failures we see most often are indirect: a 'free' entry path that is materially harder than the paid path, or a non-redeemable currency that becomes effectively redeemable through a secondary market or a support-ticket workaround.
