Is pick'em daily fantasy sports legal?
Short answer: It is the most contested format in fantasy sports. Several states treat player-versus-house pick'em products as sports wagering rather than fantasy contests, and multiple operators have exited or restructured in those states.
Traditional DFS is a peer-to-peer contest: entrants build rosters and compete against each other, and the operator takes a rake. Many state DFS statutes were written around that structure.
Pick'em products where the player selects over/under outcomes and is paid by the house look, to a number of regulators, like proposition betting with a fantasy label. Gaming regulators in several states have issued cease-and-desist letters or guidance on that basis, and some operators responded by converting to peer-to-peer formats in those jurisdictions.
The analysis is product-specific: whether the contest is house-banked, whether outcomes depend on multiple athletes, whether the entrant's skill materially determines the result, and how the state's DFS statute and sports-wagering statute interact.
