Do esports tournaments need a gambling license?
Short answer: Usually not, when the tournament is a skill competition and the prize pool is funded by the organizer or sponsors. Risk rises when entry fees fund the prize pool, when wagering is involved, or when minors participate.
A sponsor-funded tournament with skill-based competition generally sits outside gambling regulation because chance does not predominate and, in many designs, the entry consideration element is absent. Adding paid entry that funds the prize pool moves the analysis into state-specific contest and gambling statutes, some of which regulate entry-fee contests directly.
Separate issues attach regardless of licensure: prize-promotion registration and bonding requirements in some states above certain prize values, tax reporting for winners, minor participation and parental consent, and publicity-rights clearance for broadcast.
Wagering on esports outcomes is a different regime entirely and is treated as sports betting in most states that permit it.
