Where operators get caught A product can be lawful as a fantasy contest in one state, unlicensed sports wagering in the next, and a federally regulated derivative in a third — without changing a line of code. Several state regulators treat house-banked pick'em products — where an entrant selects over/under outcomes and is paid by the operator — as sports wagering rather than fantasy contest play, and have issued cease-and-desist letters on that basis. Peer-to-peer formats sit more comfortably inside most state DFS statutes. The analysis is product-specific. ### Do prediction markets need a gambling license? It depends on the regulatory path the product is built for. Event contract platforms operate under the Commodity Exchange Act through a CFTC-regulated designated contract market and take the position that federal regulation preempts state gambling law. Several state gaming regulators dispute that position for sports-related contracts, and the question is being litigated. Products not built on the federal path generally need state licensure or a skill-contest analysis. ### What is the difference between DFS and sports betting? Traditional DFS is a peer-to-peer contest where entrants build rosters of multiple athletes and compete against each other for a prize pool, with the operator taking a rake. Sports betting is house-banked wagering on event outcomes. The legal frameworks are separate: most states have a DFS statute distinct from their sports-wagering licensing regime. Products that blur the two invite regulator attention. ### Do tribal gaming compacts affect fantasy and prediction products? In compact states they can. Tribes hold exclusivity over certain classes of gaming in exchange for revenue sharing, and tribal interests have objected to commercial fantasy and event-contract products they view as encroaching on that exclusivity. Any 50-state analysis has to account for compact states separately from the general gambling statute. ### What does a fantasy or prediction market legal review cover? Contest structure and whether it is peer-to-peer or house-banked, how skill and chance interact under each state's test, state DFS registration and bonding requirements, the interaction with sports-wagering statutes, tribal exclusivity in compact states, and the entity and market-rules structure if you are pursuing the federal event contract path.
